These Terms of Service (“Terms”) apply to the purchase of tickets to and attendance at Young at Heart: A Naturist Festival (the “Festival” or “Event”), hosted by Heavenly Hosting Services LLC (“Young at Heart,” “we,” “us,” or “our”) at Sunsport Gardens.
By selecting the required acknowledgment and purchasing a ticket, you agree to these Terms, the Young at Heart Code of Conduct, the Event Waiver and Release, and the Sunsport Gardens Rules and Regulations displayed on the ticket page.
1. Tickets and Admission
A valid ticket is required for admission to ticketed Event activities and restricted areas. Tickets are valid only for the Event dates and admission type stated at purchase, unless we state otherwise.
Sunsport Gardens residents must purchase the applicable Sunsport Resident Ticket to participate in ticketed Event activities except for Sunday night music at the pool. Sunsport Resident Ticket eligibility is limited to current Sunsport Gardens residents.
We may deny admission or restrict participation if a ticket is invalid, duplicated, fraudulently obtained, used by an ineligible person, or used in violation of these Terms, the Code of Conduct, the Venue Rules, or applicable law.
All visitors must comply with Sunsport Gardens’ check-in and identification requirements, including signing in at the office upon arrival.
2. Ticket Sales, Transfers, and Refunds
Except as expressly stated in these Terms or required by applicable law, all ticket sales are final and non-refundable.
Tickets will not be refunded because of a change in personal plans, illness, transportation problems, ordinary weather, failure to attend, early departure, or removal for violating these Terms, the Code of Conduct, or the Venue Rules.
Tickets may be transferred only in accordance with procedures established by Young at Heart or the applicable ticketing platform. We may require information reasonably necessary to verify eligibility and maintain accurate registration records. Tickets may not be resold unlawfully or in violation of ticketing-platform rules.
3. Weather and Event Changes
The Event is intended to proceed rain or shine. Ordinary or reasonably anticipated weather, including rain, heat, wind, or seasonal conditions, does not entitle an attendee to a refund.
We may reasonably change the schedule, programming, activities, performers, locations, capacity, or other Event details for operational, logistical, safety, legal, weather, or other legitimate reasons. Activities may be delayed, modified, relocated, or canceled when necessary.
A change to an individual activity or portion of the program does not entitle an attendee to a refund.
4. Cancellation, Rescheduling, and Force Majeure
Circumstances beyond our reasonable control may make it impossible, impracticable, or unsafe to hold the Event as planned. These circumstances may include hurricanes, severe weather, flooding, natural disasters, governmental orders, public-health emergencies, utility failures, civil unrest, acts of terrorism, Venue closure, or similar events (“Force Majeure”).
If Force Majeure or other circumstances prevent the Event from proceeding as planned, we may postpone, reschedule, relocate, modify, or cancel the Event.
If the Event is rescheduled, previously purchased tickets will remain valid for the rescheduled date unless Young at Heart states otherwise. No refund will be provided solely because the Event was postponed or rescheduled, or because an attendee cannot attend the rescheduled date.
Except where a refund is required by law or expressly offered by us, ticket purchases remain non-refundable. We are not responsible for non-refundable travel, lodging, transportation, or other expenses.
5. Code of Conduct and Venue Rules
Attendees must comply with:
these Terms;
the Young at Heart Code of Conduct;
the Sunsport Gardens Rules and Regulations;
posted safety rules; and
reasonable instructions from Event, emergency, and Sunsport Gardens personnel.
The Code of Conduct and Venue Rules are displayed in separate collapsible sections on the ticket page and are incorporated into these Terms. If a conflict exists, a mandatory safety requirement or applicable Sunsport Gardens rule controls while the attendee is on Venue property.
6. Removal and Denial of Participation
Young at Heart or Sunsport Gardens may deny admission, restrict access to an activity or area, or require an attendee to leave the Event or Venue if the attendee:
violates these Terms, the Code of Conduct, or the Venue Rules;
engages in threatening, abusive, unlawful, unsafe, or disruptive conduct;
refuses a reasonable safety instruction;
creates a safety, security, health, or operational concern; or
provides false or materially misleading information.
Removal may occur without a refund. Serious incidents may be reported to Sunsport Gardens management or law enforcement.
7. Naturist Environment
The Festival is held in a naturist environment. Nudity is expected when conditions permit and is required in the pool, hot tub, sauna, and fenced area surrounding those facilities, subject to the Sunsport Gardens Rules and Regulations.
Nudity, attendance, conversation, friendliness, or participation in an activity does not constitute consent to touching, sexual conduct, photography, recording, or any other interaction.
8. Photography, Video, and Privacy
Photography, video recording, livestreaming, and other image or audio capture are subject to the Sunsport Gardens Rules and Regulations and the Code of Conduct.
Attendees may not photograph, record, livestream, or distribute an identifiable image or recording of another person without that person’s permission.
Young at Heart will not intentionally use an identifiable attendee’s image for promotional purposes without the consent required by applicable law and our event procedures. Photos will not be used for promotional purposes without a consenting photo release form submission.
9. Alcohol and Substances
Alcohol may be consumed only in compliance with applicable law, Event policies, and the Venue Rules.
We may remove an attendee whose conduct is unsafe, disruptive, or inappropriate, regardless of whether alcohol, drugs, medication, or another substance contributed to the conduct.
10. Minors
A minor may attend only with a parent or legal guardian who remains responsible for the minor’s supervision, safety, and conduct at all times. Parents and guardians must complete all required registration, consent, and waiver documents and comply with Sunsport Gardens’ requirements concerning minors.
11. Medical and Emergency Situations
Attendees are responsible for their own medical care and expenses. In an emergency, Event or Venue personnel may contact emergency services or take reasonable steps to obtain emergency assistance on an attendee’s behalf.
12. Personal Property
Attendees are responsible for their own money, valuables, vehicles, equipment, clothing, and other property. To the fullest extent permitted by law, Young at Heart, Heavenly Hosting Services LLC, Sunsport Gardens, INC, and their respective personnel are not responsible for property that is lost, stolen, or damaged, except to the extent caused by conduct for which liability cannot lawfully be excluded.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Young at Heart, Heavenly Hosting Services LLC, and their respective owners, officers, employees, volunteers, contractors, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to attendance at, participation in, or inability to attend the Event.
The separate Event Waiver and Release governs the attendee’s release, assumption of risk, and related obligations. Nothing in these Terms or the Waiver excludes or limits liability that cannot legally be excluded or limited.
14. Attendee Responsibility
To the fullest extent permitted by law, an attendee is responsible for claims, damages, losses, and reasonable expenses arising from the attendee’s negligent, reckless, willful, unlawful, or prohibited conduct, or violation of these Terms, the Code of Conduct, or the Venue Rules.
This provision does not require an attendee to assume responsibility for Young at Heart’s, Heavenly Hosting Services LLC’s, Sunsport Gardens, INC’s, or another party’s negligence or misconduct where applicable law does not permit that responsibility to be imposed.
15. Changes to These Terms
We may update these Terms before purchase when reasonably necessary to address Event changes, Venue requirements, safety considerations, legal requirements, or circumstances beyond our reasonable control.
The version displayed and accepted at purchase will govern that purchase, except for later changes reasonably necessary for safety, Venue operations, or compliance with law. Material changes will be communicated through reasonable means when practicable.
16. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Broward County, Florida.
17. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or, if necessary, severed. The remaining provisions will remain in effect.

By selecting the required Terms checkbox and clicking “Purchase,” you acknowledge that you had an opportunity to review these Terms and agree to comply with them as a condition of purchasing a ticket and attending the Event.
