Event Waiver and Release

This Event Waiver and Release (“Waiver”) applies to participation in and attendance at Young at Heart: A Naturist Festival (the “Event”) at Sunsport Gardens. “Released Parties” means Heavenly Hosting Services LLC, the organizer of Young at Heart: A Naturist Festival, and their respective owners, officers, directors, employees, agents, volunteers, contractors, sponsors, vendors, and representatives.

1. Acknowledgment of Risks

I understand that attendance at and participation in the Event may involve risks, including risks associated with:

  • Nudity and naturist participation;

  • swimming, hot tubs, saunas, boating, or water activities;

  • outdoor conditions, weather, heat, rain, insects, and wildlife;

  • camping and use of resort facilities;

  • walking on resort grounds;

  • uneven or slippery terrain;

  • alcohol consumption;

  • photography and Consent Photo Bingo

  • activities operated by vendors or third parties; and

  • the acts or omissions of other attendees or third parties.

I understand that these risks may result in property damage, illness, personal injury, disability, or death.

2. Assumption of Risk

I voluntarily choose to attend and participate in the Event. I knowingly and voluntarily assume the ordinary and inherent risks associated with attendance and participation, including risks that are known or reasonably foreseeable to me.

I agree to exercise reasonable care for my own safety, follow applicable instructions and rules, and determine whether an activity is appropriate for me.

3. No Guarantee of Safety

I understand that no Released Party guarantees that the Event, facilities, activities, equipment, services, or safety measures will be safe, uninterrupted, or free from hazards. This provision does not exclude or limit liability that applicable law does not permit to be excluded or limited.

4. Release

To the fullest extent permitted by law, I release and waive claims against the Released Parties arising from my attendance at or participation in the Event, including claims for personal injury, death, illness, or property damage caused by the ordinary negligence of a Released Party or arising from an inherent or ordinary risk of the Event.

This release does not apply to claims that cannot lawfully be released, including claims arising from a Released Party’s gross negligence, reckless conduct, intentional misconduct, or other conduct for which liability cannot legally be waived.

5. Personal Property

To the fullest extent permitted by law, I assume responsibility for my personal property and release the Released Parties from claims for property that is lost, stolen, or damaged, except to the extent the claim arises from conduct for which liability cannot lawfully be excluded.

6. Indemnification
To the fullest extent permitted by applicable law, I agree to indemnify and hold harmless the Released Parties from third-party claims, damages, losses, liabilities, and reasonable expenses, including reasonable attorneys’ fees, arising from:

  • my negligent, reckless, willful, unlawful, or prohibited conduct;

  • my violation of the Event Terms of Service, Code of Conduct, or Sunsport Gardens Rules and Regulations; or

  • my conduct that causes injury to another person or damage to property.

This obligation does not require me to indemnify a Released Party for that party’s own negligence or misconduct where applicable law does not permit such an obligation.

7. Medical and Emergency Authorization

I understand that I am responsible for my own medical care and expenses. In an emergency, I authorize Event or Venue personnel to contact emergency services and provide information reasonably necessary to obtain emergency assistance on my behalf.

8. Minors

If I am signing for a minor, I represent that I am the minor’s parent or legal guardian and have authority to sign this Waiver. I agree to supervise the minor and accept responsibility for the minor’s compliance with the Event Terms of Service, Code of Conduct, and Venue Rules.

9. No Waiver of Non-Waivable Rights

This Waiver releases only claims that may lawfully be released. It does not waive or limit any right or claim that applicable law prohibits a person from waiving or limiting.

This Waiver does not grant permission to use my name, image, likeness, or voice for promotional purposes; any such permission must be provided separately.

10. Acknowledgment and Acceptance

I have had an opportunity to read this Waiver and understand that it releases certain claims against the Released Parties and requires me to assume specified risks and accept responsibility for my own conduct.
